1. Acceptance of Terms

By accessing or using the Trauma & Empathy platform ("Platform"), operated by DR.Oogle Inc, you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you may not access or use the Platform.

2. Eligibility

The Platform is intended solely for users 18 years of age or older. By using the Platform, you represent and warrant that you are at least 18 years old. We reserve the right to terminate accounts of users found to be under the age restriction.

In accordance with the Children's Online Privacy Protection Act (COPPA), we do not knowingly collect information from or direct any services to children under 13 years of age.

2.1 Rationale for Age Restriction

While many social media platforms permit users as young as 13, our platform restricts membership to individuals 18 years of age or older for several important reasons:

  • Clinical Considerations: Trauma processing for minors is typically guided by mental health professionals in structured settings. Our platform explicitly states it is not a substitute for professional mental health services, which is particularly important for younger individuals who benefit from more direct professional support when addressing trauma.
  • Legal Protections: Minors have additional legal protections under various regulations including COPPA and similar laws worldwide. Allowing them on a platform where traumatic experiences are shared could create substantial legal exposure and complications, particularly regarding content moderation and data privacy.
  • Informed Consent: Adults can more fully understand the potential psychological impacts of engaging with traumatic content and make informed decisions about their participation. The ability to provide meaningful informed consent is crucial given the nature of our platform.
  • Content Appropriateness: The detailed nature of trauma discussions on our platform, while valuable for adult healing, may not be appropriate for minors who are still developing emotional regulation skills and psychological resilience.

We acknowledge that childhood trauma affects people of all ages, including those under 18. For minors seeking support for traumatic experiences, we strongly encourage:

3. Platform Purpose

Trauma & Empathy is designed for users to share childhood memories, particularly those related to trauma, in a structured and safe environment for reflection, empathy, and recovery.

The Platform does not provide therapy, medical advice, or crisis intervention. It is not a substitute for professional mental health services. We strongly encourage users to seek support from trusted professionals, friends, or family members, especially when sharing content that may trigger strong emotional responses.

Important Notice: This platform is not an appropriate venue for first-time disclosures of childhood abuse, molestation, or other criminal acts. If you have not previously disclosed such experiences to appropriate authorities or professionals, we strongly urge you to seek professional support before sharing on this platform.

4. User Conduct

Users must adhere to the following guidelines:

  • Share only childhood memories, not experiences from adulthood.
  • Share specific events rather than summarizing your entire childhood.
  • Engage in respectful communication and interactions.
  • No graphic or explicit content that may be harmful to others.
  • No use of swear words or obscene language. While we understand that sharing trauma can evoke strong emotions, we ask that users refrain from language that may disrupt the supportive environment.
  • No personally identifiable information or contact details of yourself or others.
  • No information that could reasonably lead to the identification of specific individuals involved in your memories.
  • No hate speech, threats, harassment, or discriminatory language based on race, color, religion, national origin, ethnicity, gender, gender identity, sexual orientation, disability, or any other protected characteristic.
  • No content related to self-harm in your past or in your present.
  • No posting of social media handles or other contact information.

Violations of these guidelines may result in content removal, warnings, or account termination.

5. Prohibited Conduct & Content

To ensure a safe and supportive environment, the following types of content and behavior are strictly prohibited on the platform:

5.1 Content Violations

  • Spam/Self-Promotion: Posting repetitive, unsolicited, or commercial content, including advertisements, referral links, or promotional codes.
  • Content Recycling: Creating and sharing posts that are substantially similar to content you have previously shared, with only minor variations, in an attempt to gain additional exposure.
  • Double Posting: Sharing the exact same content multiple times across the platform.
  • Bulk Posting: Uploading numerous posts in quick succession that overwhelm community feeds and diminish user experience.
  • Harassment: Any content intended to abuse, intimidate, threaten, or cause emotional distress to other users.
  • Misinformation: Deliberately sharing false information that could be harmful or misleading to other users, particularly regarding mental health treatments, legal processes for reporting abuse, or therapeutic approaches.
  • NSFW Content: Any sexually explicit, pornographic, or excessively graphic content, including detailed descriptions of sexual abuse beyond what is necessary to convey the experience.
  • Off-Topic: Content that deviates significantly from the platform's purpose of sharing childhood memories and experiences for reflection and healing.
  • Misleading: Content that intentionally misrepresents experiences or facts, including fabricated stories presented as authentic memories.
  • Affiliate Marketing: Sharing content with embedded affiliate links or promoting products, services, or treatments with financial incentives.

5.2 Behavioral Violations

  • Multiple Reported Comments: Users who have a pattern of posts or comments that are frequently reported by the community may face moderation action, even if individual violations are minor.
  • Excessive Self-Promotion: Repeatedly directing users to external resources, services, or platforms, especially when there is a personal or financial interest involved.
  • Heated Discussion: Engaging in or provoking hostile exchanges that disrupt the supportive environment of the platform, even if individual comments don't clearly violate other rules.
  • Attempting to Identify Users: Any efforts to determine the real identity of other platform users, including asking for identifying details or cross-referencing information from posts.
  • Creating Multiple Accounts: Operating multiple accounts to evade moderation, manipulate platform features, or harass other users is prohibited. However, we understand that some users may have legitimate reasons for creating separate accounts (e.g., to compartmentalize different aspects of their trauma). If you believe you have a valid reason for multiple accounts, please contact us to discuss your situation.

5.3 Prohibited Discussions and Debates

Our platform is specifically designed for sharing and reflecting on childhood memories in a supportive environment. To maintain this focused purpose and ensure a healing-centered space, we do not permit:

  • Political, Social, Family or Parenting Discussions: Content primarily focused on raising political, social, family or parenting concerns, highlighting systemic discrimination, injustices, prejudice, or bias belongs on platforms dedicated to those discussions and will be considered off-platform. While content that connects personal childhood memories to larger issues issues is permitted, posts that are focused primarily on larger socio-political, family or parenting issues may be considered off-topic.
  • Controversies Around Treatment Approaches: Debates about the efficacy, validity, or superiority of various treatment methods for PTSD, C-PTSD, or other trauma-related conditions. While you may mention what has helped you personally, advocating for specific approaches or criticizing others' treatment choices is not permitted.
  • Present-Day Family Relationship Discussions: Debates or advice-seeking about parent-child relationships, sibling dynamics, or decisions regarding family contact (including "going no-contact" with family members, estrangement, or reconciliation) are not permitted. While sharing childhood experiences involving family members is central to our platform, discussions about how to manage these relationships in the present should be directed to appropriate support forums or professional counselors.

Content or comments that shift toward these types of debates will be subject to moderation, including possible removal, visibility restrictions, or other actions. While we respect the importance of these topics, our platform is not structured to facilitate productive conversations in these areas. We encourage users to seek appropriate forums dedicated to these specific discussions.

5.4 Past-Focused Orientation

The core purpose of this platform is to provide a space for sharing and reflecting on past childhood experiences. All content and interactions should maintain this past-oriented focus:

  • Share memories, not current situations: Posts should describe specific childhood experiences rather than current challenges, ongoing relationships, or present circumstances.
  • Reflection rather than advice-seeking: The platform is designed for reflective sharing of what happened in your childhood, not for seeking advice about current situations or relationships.
  • Historical context is welcome: You may provide context about when and where your experiences occurred, including relevant cultural, historical, or situational factors that help others understand your childhood experience.
  • Limited present connection: Brief mentions of how past experiences connect to your present understanding are acceptable, but the primary focus must remain on the childhood experience itself.
  • Similar experience sharing is encouraged: We welcome and encourage users to discuss and connect over similar childhood experiences. One of the core purposes of our platform is to identify and match similar childhood memories as shared by users. These connections, which we call "Related" experiences, can foster understanding, validation, and healing.

Content that primarily focuses on present circumstances, current relationship dynamics, or contemporary issues may be subject to moderation, including possible removal or visibility restrictions. Our moderators will evaluate content based on whether it maintains appropriate focus on childhood experiences rather than current situations.

5.5 Prohibition of Unqualified Life Coaching

Our platform is designed for sharing personal childhood memories, not for providing or receiving life advice. We strictly prohibit content that constitutes unqualified life coaching, particularly regarding significant life decisions related to family relationships.

Prohibited Advice: The following types of content are not permitted:

  • Family Estrangement Recommendations: Statements encouraging or advising others to "go no contact" or "cut off family members" from their lives, regardless of the situation described
  • Prescriptive Life Direction: Directive advice about major life decisions that should be made with professional guidance (e.g., "You should leave your family," "You need to estrange yourself from your parents")
  • Generalized Treatment Recommendations: Definitive claims about what treatments or approaches "work" or are "necessary" for healing from trauma
  • Self-Promotion as an Authority: Positioning oneself as an authority on trauma, recovery, or family dynamics without relevant professional credentials

Rationale: Decisions regarding family relationships, particularly estrangement, are complex, highly individualized, and can have profound long-term consequences. Such advice, when provided by unqualified individuals in a public forum, may:

  • Lead to harmful outcomes for vulnerable individuals
  • Oversimplify complex psychological and relational issues
  • Substitute for proper professional guidance
  • Create liability concerns for both users and the platform

Posts or comments containing such unqualified advice may be removed, have their visibility reduced, or result in account warnings or restrictions. Repeated violations may lead to account termination.

No Promotion of Family Cut-Offs: We recognize that family dynamics are deeply personal and unique to each individual's circumstances. Blanket advice regarding solutions you have implemented in your own family relationships, especially decisions to cut ties or become estranged from family members, siblings, spouse or children, is not permitted in your posts or comments.

6. Photo Uploads

Our platform allows users to upload photos to accompany their childhood memories. To maintain privacy, safety, and the platform's purpose, all photo uploads must adhere to the following guidelines:

6.1 Photo Content Requirements

  • Self-Only Photos: Photos must only include you as a child, ideally from the same age period as the memory you're sharing. Photos containing any other individuals, including family members, friends, or other children, will be removed.
  • Age-Appropriate: Photos must be of you as a child or adolescent (under 18 years old).
  • No Photos of Adults: Photos that include adults are not permitted. This helps protect the privacy and safety of others and prevents identification, doxxing, or revenge-posting of people people who may be mentioned—either directly or indirectly—in your memories.
  • No Identifying Information: Photos should not display personally identifying details, including but not limited to:
    • School names, addresses, or name tags
    • Visible street signs or house numbers
    • Documents of any kind (birth certificates, report cards, medical records, etc.)
    • Name badges or personalized items that show your full name
    • Computer screens displaying personal information

    Example: A childhood photo where you're holding a birthday card with your full name and address visible would not be permitted. Similarly, a photo of you standing in front of a clearly visible school sign would not be allowed.

  • No Vulnerable Situations: Photos should not show you in vulnerable situations, including:
    • Bathing or in states of undress
    • In underwear or diapers (beyond infancy)
    • In medical treatment settings
    • In distress or during punishment

    Example: A photo of you as a toddler in a bathtub, even if no nudity is visible, would not be appropriate for the platform.

  • No Institutional Settings: Photos taken in institutional settings such as orphanages, hospitals, residential schools, or detention facilities are not permitted, as these may:
    • Identify the specific institution
    • Include other children or staff inadvertently
    • Potentially re-traumatize you or other users

    Example: Even a solo photo of you in a clearly identifiable hospital room or orphanage dormitory would not be permitted.

  • No Environmental Evidence of Abuse: Photos that show environmental evidence of abuse or neglect are not permitted, even if no people are visible in the image. This includes:
    • Damaged living conditions
    • Physical restraints or punishment devices
    • Unsafe or unsanitary environments

    Example: A photo of a severely damaged bedroom that illustrates neglect would not be permitted, even if you're not in the photo.

  • Restricted Religious Ceremony Photos: Photos from religious ceremonies or settings are only permitted if:
    • They show only you (no religious officials or other participants)
    • They don't feature religious symbols or settings that played a harmful role in your life
    • They don't identify the specific religious institution

    Example: A simple portrait of you in religious attire would be permitted, but a photo showing you with religious leaders or in an identifiable religious institution would not be allowed.

  • Appropriate Content: Photos must not contain nudity, inappropriate content, or depictions of abuse. Even if such images are relevant to your childhood experience, they cannot be shared on the platform. This includes:
    • Any nudity as defined in standard content policies (genitalia, buttocks, female nipples)
    • Implied nudity through transparent clothing
    • Sexualized poses or contexts
    • Signs of physical abuse or injury

    Example: A photo showing visible injuries from abuse would not be permitted, even if you wish to document what happened to you.

  • Authentic Photos Only: Photos must be authentic childhood photos of you. Do not upload AI-generated images or stock photos.

6.7 Cross-Memory Considerations

Because memories from the same user are grouped together, special considerations apply to ensure appropriate content separation:

  • Content Consistency: Our moderators may review your complete collection of memories and photos to ensure consistency with our guidelines.
  • Contextual Review: Photos that may be acceptable on their own might be removed if, when viewed in the context of your other memories, they create inappropriate associations or could be triggering to you or other users.
  • Changing Content Categories: If you later add memories that change the nature of your content collection (such as adding memories of sexual abuse), previously acceptable photos may be re-evaluated.

6.8 Examples of Permitted vs. Prohibited Photos

Permitted Photo Examples:

  • A solo portrait of you as a child with a neutral background
  • A photo of you playing alone in a generic park setting (without identifying features)
  • A school portrait showing only you with a standard background
  • A photo of you in age-appropriate attire engaging in a hobby or activity alone
  • A photo of you with a childhood pet (provided only you and the pet are visible)

Prohibited Photo Examples:

  • Any photo showing you with other children or adults
  • Photos showing your full name, address, or school name
  • Photos showing you in underwear, a bathing suit, or partially clothed
  • Photos taken in a medical setting (hospital room, doctor's office)
  • Photos that include visible injuries or signs of abuse
  • Photos of documents (birth certificates, report cards, etc.)
  • Photos of you in an identifiable institutional setting
  • Photos of rooms or environments that show evidence of neglect or abuse
  • Group photos of any kind, even if you're in them
  • Photos that include religious officials or identifiable religious buildings

7. Content Moderation & Safety Measures

To maintain a safe and supportive environment, the Platform implements the following safety measures:

  • Moderators may review posts after publication
  • Users can report rule violations
  • Private posting option for personal reflection
  • Ability to share content with therapists or trusted individuals via private links
  • Content screening for potentially identifying information
  • Content filters for users to opt out of seeing certain types of sensitive content

7.1 Content Filtering System

Our platform acknowledges that sharing traumatic experiences is a core function, while also respecting that users may wish to control their exposure to certain topics.

  • Tagging Sensitive Content: When creating a post that contains potentially triggering or sensitive material, posters can tag their content with relevant topic indicators. This is not censorship but an act of community care.
  • Opt-Out Filtering: Users can customize their content filters to opt out of seeing posts with specific tags. This gives each user control over what types of content they encounter.
  • How It Works: Sensitive topics on a trauma-sharing platform are not illegal. However, posters can tag sensitive topics in their posts as an act of care for others. If the poster has tagged their post, you can opt out of seeing it.
  • Sensitive Content Categories: Available content tags that users can apply to their posts include:
    • Severe Trauma / PTSD
    • Physical Abuse
    • Child Sexual Abuse
    • Emotional Abuse
    • Narcissistic Abuse
    • Neglect
    • Substance Abuse
    • Self-Harm
    • Violence
    • Criminal Behavior
    • Distressing Events
    • War
    • Discrimination
    • Death
    • Suicide
    • Serious Injury
    • Serious Illness
    • Other Event
  • Default Settings: By default, all users will see content with all tags (all topics are included). Users can adjust these settings at any time to opt out of seeing content with specific tags that they prefer not to encounter.

7.2 Moderation Actions

Our moderation team may take various actions based on the nature and severity of violations, including:

  • Issuing warnings for minor or first-time violations
  • Removing content that violates our policies
  • Temporarily restricting account features
  • Reducing content visibility or implementing "sandboxing" (restricting content distribution to limited audiences). If your content is sandboxed, you will receive a notification explaining the reason and how you can appeal the decision.
  • Locking threads that contain heated discussions
  • Issuing temporary bans for serious or repeated violations
  • Permanent account termination for severe or persistent violations

7.3 Appeal Process

7.4 Emotional Impact of Moderation

We understand that having your content removed or restricted can be emotionally challenging, especially when sharing personal experiences. 7.5 Distinction Between Filtering and Moderation

It's important to understand the difference between our content filtering system and content moderation:

  • Content Filtering: A user-controlled system that allows individuals to opt out of seeing certain tagged content. Content that is filtered is still available on the platform for users who have not opted out.
  • Content Moderation: Platform-enforced actions taken when content violates our terms of service or community guidelines. Moderated content may be removed, restricted, or otherwise limited regardless of user filter preferences.

We believe this dual approach respects both the importance of sharing authentic experiences and the need for personal boundaries when engaging with sensitive content.

8. Anti-Harassment & Anti-Discrimination Policy

In accordance with Delaware's Safe Internet Act and federal laws against cyberbullying and online harassment, the Platform maintains a zero-tolerance policy for any form of harassment, bullying, stalking, or intimidation. This includes but is not limited to:

  • Targeting users with unwanted or offensive content
  • Persistent unwelcome comments or interactions
  • Intimidation or threats
  • Encouraging others to harass a user
  • Attempting to identify anonymous users

We strictly prohibit any content that discriminates against, disparages, or denigrates individuals based on:

  • Race, color, or ethnicity
  • Religion or religious beliefs
  • National origin
  • Gender, gender identity, or gender expression
  • Sexual orientation
  • Disability or medical condition
  • Age
  • Veteran status
  • Any other characteristic protected by applicable law

Violations may result in immediate account termination and, in severe cases, may be reported to appropriate authorities.

9. Privacy & Anonymity

The Platform is designed to be fully anonymous. Usernames are randomly generated (e.g., AB1234), and no real names or personally identifiable information should be included in posts.

By using the Platform, you agree:

  • Not to attempt to identify other users
  • Not to share your own identifying information
  • Not to use the Platform to collect data about other users

10. User Mental Health Responsibility

While using the Platform, users acknowledge their responsibility for their own mental health and agree to the following:

Tips on How to Share Sensitively:

  • Respect Your Emotions — Delving into your memories in detail may bring up challenging emotions. Some of these memories may be emotionally intense and difficult to handle, potentially causing feelings of overwhelm, flashbacks, anxiety, distress, or other physical and emotional symptoms.
  • Skip What Feels Overwhelming — If there's anything in your memory that feels too heavy, difficult, intense or overwhelming we encourage you to skip it, knowing you can return whenever you feel prepared.
  • Emotions Might Change — You may feel okay now while reflecting on your memories, but emotions can shift unexpectedly. It's possible to become distressed or even depressed later. Please consider talking to a mental health professional, friend, family member, or trusted support person.
  • Take Breaks — The process doesn't have to be completed in one sitting, and you're free to revisit or add details as you feel ready.
  • Honor Your Well-Being — Please use our platform in a way that honors your emotional well-being, taking all the time you need. Take it easy on yourself, go at your own pace, and remember, if you start to feel overwhelmed, you can take a break from the site and come back when you're ready.
  • What to Do if You Become Distressed — If you become distressed or experience thoughts of self-harm, we suggest in the strongest possible terms to reach out to a mental health professional or someone else you trust for immediate help and advice.

Risks of Reading Similar Experiences: Reading about experiences similar to your own can sometimes cause distress, flashbacks, or re-triggering of traumatic memories. You might find yourself reliving difficult episodes from your past, experiencing physical sensations of anxiety, or having intrusive thoughts. These reactions are common responses to engaging with content that resonates with your own trauma history.

Recovered or Newly Remembered Memories: While using the Platform, you may recall memories you had previously forgotten or develop new understandings of past experiences. The Platform does not validate or authenticate the accuracy of any memories. You acknowledge that:

  • Memory is complex and subjective, and can be influenced by various factors
  • The Platform cannot verify the accuracy of any memories shared
  • You assume full responsibility for how you interpret, process, and act upon any recovered or newly remembered experiences
  • Any actions you take based on memories recalled while using the Platform are entirely your own responsibility
  • Changes in your understanding of past events may impact your current relationships
  • You accept all responsibility for any potential harm or damage that may arise to your own mental health and your relationships with others as a result of engaging with remembered experiences

By using the Platform, you acknowledge and accept that engaging with traumatic memories may have emotional consequences, and you agree to use the Platform mindfully and responsibly regarding your mental health. You understand that DR.Oogle Inc and the Trauma & Empathy platform are not responsible for any psychological distress, emotional harm, trauma triggers, suicidal ideation, self-harm behaviors, or other mental health consequences that may result from your use of the Platform. The Platform is not a substitute for professional mental health treatment, and you assume all risks associated with recalling, processing, and sharing potentially traumatic memories.

11. User Rights & Content Ownership

You retain ownership of the content you submit, but grant DR.Oogle Inc a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your content solely for the purpose of operating and improving the Platform.

This license ends when you delete your content or account unless your content has been shared with others who have not deleted it.

Under the Digital Millennium Copyright Act (DMCA), if you believe content on the Platform infringes your copyright, please contact us with the required information to process a takedown request.

12. User Warranties

When posting content on our Platform, you expressly warrant that:

  • Your content is truthful and based on your actual experiences
  • You have the right to share the content, including any photos or images you upload
  • Your content does not violate the rights of any third party

Violation of these warranties may result in content removal, account suspension, or termination.

13. Account Termination

We reserve the right to{" "} terminate or suspend your account without prior notice or liability for any reason, including but not limited to:

  • Violation of these Terms of Use
  • Engaging in harassment or abusive behavior
  • Posting prohibited content
  • Attempting to breach the Platform's anonymity
  • Using the Platform for unauthorized purposes
  • Spam, self-promotion, or affiliate marketing
  • Posting misinformation or misleading content
  • Sharing NSFW or inappropriate content
  • Creating multiple accounts to evade moderation
  • Pattern of behavior resulting in multiple reported comments

Upon termination, your right to access and use the Platform will immediately cease.

14. Prohibited Activities

In addition to the conduct guidelines, the following activities are strictly prohibited:

  • Attempting to circumvent any Platform security measures
  • Using automated systems or software to extract data from the Platform
  • Impersonating another user or Trauma & Empathy staff
  • Soliciting personal information from users
  • Using the Platform for any illegal activity
  • Attempting to interfere with the proper functioning of the Platform
  • Creating multiple accounts to evade moderation or restrictions
  • Initiating or participating in heated discussions that disrupt the supportive environment
  • Posting off-topic content unrelated to the platform's purpose

17. Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without DR.Oogle Inc's prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and of no effect. DR.Oogle Inc may freely assign or transfer these Terms without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors and permitted assigns.

18. Notifications

Any notices or other communications provided by Trauma & Empathy platform and DR.Oogle Inc under these Terms, including those regarding modifications to these Terms, will be given by:

  • Email to the address associated with your account
  • A prominent notice on the Platform
  • A message to your account on the Platform

The date of receipt will be deemed the date on which such notice is transmitted. Trauma & Empathy platform and DR.Oogle Inc's failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of DR.Oogle Inc.

19. Disclaimer of Liability

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

DR.Oogle Inc does not warrant that:

  • The Platform will be uninterrupted or error-free
  • Defects will be corrected
  • The Platform is free of viruses or other harmful components
  • The Platform will meet your specific requirements

We are not responsible for any emotional distress, psychological impact, or other consequences resulting from using the Platform. Users are encouraged to exercise caution and seek professional support when dealing with traumatic memories.

20. Limitation of Liability

To the maximum extent permitted by applicable law, DR.Oogle Inc shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, damages for emotional distress, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Platform
  • Any conduct or content of any third party on the Platform
  • Any content obtained from the Platform
  • Unauthorized access, use, or alteration of your transmissions or content

21. Indemnification

You agree to defend, indemnify, and hold harmless DR.Oogle Inc, its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

  • Your use of and access to the Platform
  • Your violation of any term of these Terms of Use
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right
  • Any claim that your content caused damage to a third party
  • Any emotional distress, psychological harm, exacerbation of mental health conditions, self-harm incidents, suicidal thoughts or attempts, or other mental health consequences you may experience as a result of engaging with potentially traumatic memories on the Platform
  • Any decision you make regarding your mental healthcare based on your interactions with the Platform
  • Any harm to yourself or others that may result from triggers, flashbacks, or emotional responses activated by using the Platform

You acknowledge that working with traumatic memories inherently carries risks to mental wellbeing that DR.Oogle Inc and the Trauma & Empathy platform cannot fully mitigate, despite providing guidelines and recommendations for safe usage. You assume full responsibility for managing your emotional responses and seeking appropriate professional help when needed.

22. Compliance with Laws

The Platform complies with applicable federal and state laws, including but not limited to:

  • Children's Online Privacy Protection Act (COPPA)
  • Communications Decency Act Section 230
  • Delaware Online Privacy Protection Act
  • Delaware Cyberbullying Prevention Act
  • Federal anti-harassment and anti-stalking laws
  • Mandatory reporting laws regarding child abuse and exploitation
  • Americans with Disabilities Act (for digital accessibility)
  • Federal and state laws prohibiting discrimination

Mandatory Reporting: In compliance with Delaware and federal laws regarding mandatory reporting, DR.Oogle Inc may be obligated to report certain content to appropriate authorities, including:

  • Content indicating ongoing or current child abuse
  • Content suggesting imminent harm to self or others
  • Content describing unreported serious crimes

Users are also expected to comply with all applicable laws when using the Platform.

23. Changes to the Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Platform with an updated "Last Updated" date.

Your continued use of the Platform after any changes indicates your acceptance of the modified terms. We encourage users to regularly review the Terms of Use.

24. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law principles.

Any legal action or proceeding arising out of or related to these Terms or the Platform shall be brought exclusively in the courts of Dover, Delaware, and you consent to the personal jurisdiction of such courts.

25. Arbitration

You and DR.Oogle Inc agree that the exclusive remedy for all disputes and claims relating in any way to, or arising out of, these Terms, the Services, or your use of the Platform (including, to the extent permitted by applicable law, the arbitrability of any claim or dispute and the enforceability of this paragraph), or to any other alleged act or omission by you or DR.Oogle Inc toward the other, shall be determined exclusively by final and binding arbitration.

The arbitration shall be conducted under the Commercial Arbitration Rules of the American Arbitration Association ("AAA") before a panel of three arbitrators and conducted in Dover, Delaware. You and DR.Oogle Inc also agree that the AAA Optional Rules for Emergency Measures of Protection shall apply to the proceedings.

You and DR.Oogle Inc may litigate in court only to compel arbitration under these Terms or to confirm, modify, vacate or enter judgment on the award rendered by the arbitrators. To the extent that you have breached or have indicated your intention to breach these Terms in any manner which violates or may violate DR.Oogle Inc's intellectual property rights, or may cause continuing or irreparable harm to DR.Oogle Inc, DR.Oogle Inc may seek injunctive relief, or any other appropriate relief, in any court of competent jurisdiction.

You and DR.Oogle Inc must commence an arbitration by filing a demand for arbitration with the AAA within ONE (1) YEAR after the date the party asserting the claim first knows or reasonably should know of the act, omission or default giving rise to the claim; and there shall be no right to any remedy for any claim not asserted within that time period.

To the fullest extent permitted by applicable law: no arbitration under these Terms shall be joined to an arbitration involving any other current or former user of the Platform, whether through class arbitration proceedings or otherwise; and no finding or stipulation of fact in any other arbitration, judicial or similar proceeding may be given preclusive or collateral estoppel effect in any arbitration hereunder.

26. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect and enforceable.
